Recently asked questions about conveyancing in Blackwall

My husband and I are looking to acquire a flat in Blackwall and are in fact using a Blackwall conveyancing practice. Within the last couple of days our conveyancer has sent a preliminary report and documents to look through with the expectation that exchange is imminent. Virgin Money have this evening contacted us to advise us that they have now hit a problem as our Blackwall lawyer is not on their conveyancing panel. Please explain?

If you are buying a property with the assistance of a mortgage it is usual for the purchasers' lawyers to also represent the purchaser's lender. In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Accreditation Scheme. Your solicitor should contact your mortgage company and see if they can apply for membership of their conveyancing panel, but if that is not viable they will instruct their own solicitors to act. You don't have to instruct a firm on the bank's conveyancing panel and you may continue to use your own Blackwall solicitors, in which case your legal fees may increase, and it will likely delay the transaction as you are adding another lawyer into the mix.

I am the registered owner of a freehold premises in Blackwall but still invoiced for rent, why is this and what is this?

It’s unusual for properties in Blackwall and has limited impact for conveyancing in Blackwall but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.

Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges date back hundreds of years, but the Rent Charge Act 1977 barred the establishment of new rentcharges from 1977 onwards.

Previous rentcharges can now be redeemed by making a one off payment under the Act. Any rentcharges that are still in existence in 2037 is to be extinguished.

What happens if my lawyer’s firm is expelled from the Principality Solicitor panel ahead of completing my conveyancing in Blackwall?

The first thing to point out is that, this is a very rare occurrence. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have to instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by a regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit for a fee.

Over the last few months I have been searching for a leasehold apartment up to £195,000 and identified one close by in Blackwall I like with amenity areas and railway links in the vicinity, the downside is that it's only got 49 years on the lease. I can't really find anything else in Blackwall suitable, so just wondered if I would be making a mistake buying a lease with such few years left?

Should you require a home loan the remaining unexpired lease term may be a potential deal breaker. Reduce the price by the amount the lease extension will cost if not already taken into account. If the existing owner has owned the premises for a minimum of twenty four months you can request that they commence the lease extension formalities and pass it to you. An additional ninety years can be extended on to the existing lease with a zero ground rent applied. You should speak to your conveyancing solicitor about this matter.

Do I stop the direct debit for my mortgage with Nationwide once a completion date for my sale in Blackwall has been agreed?

No, you must keep meeting any mortgage sums to Nationwide until the mortgage is repaid from the proceeds of sale as part of your Blackwall conveyancing.
