My husband and I are hoping to purchase a property in Bredbury and are in fact using a Bredbury conveyancing practice. Within the last couple of days our property lawyer has sent a preliminary report and documents to look through with the expectation that exchange is imminent. Virgin Money have this morning contacted us to advise us that they have now hit a problem as our Bredbury lawyer is not on their conveyancing panel. What do we do from here?

When purchasing a property with the benefit of a mortgage it is standard for the purchasers' lawyers to also act for the purchaser's lender. In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Quality Scheme. Your solicitor should contact your mortgage company and see if they can apply for membership of their conveyancing panel, but if that is not viable they will instruct their own solicitors to act. You don't have to instruct a firm on the bank's conveyancing panel as you are at liberty to use your preferred Bredbury lawyers, in which case it will likely add costs, and it may delay matters as you are adding another lawyer into the mix.

Forgive me if this question is silly but I am unseasoned as a 1st time purchaser of a garden flat in Bredbury. Do I collect the keys to the house on the completion date from my conveyancer? If so, I will appoint a High Street conveyancing solicitor in Bredbury?

There is no need to visit the lawyers office on the day of completion. Conveyancing lawyers for you will electronically transfer the completion advance to the vendor’s solicitors, and shortly after the monies have arrived, you should be able to collect the keys from the Estate Agents and start moving into the property. This tends to happen early afternoon.

We expect to receive a OIP from Kent Reliance this week so we can work out what to offer on a property we like as otherwise we only have online calculators to go by (which aren't taking into account credit checks etc). Do Kent Reliance recommend any Bredbury solicitors on the Kent Reliance conveyancing panel, or is it better to go independently?

You will need to appoint Bredbury solicitors independently although you'll need to choose one on the Kent Reliance conveyancing panel. The solicitor represents both you and Kent Reliance through the process.

I am currently in the process of buying my council flat in Bredbury. I have a mortgage offer with Lloyds. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should have one. Any advice?

It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with Lloyds, you will need to appoint a solicitor on the Lloyds conveyancing panel.
