We are close to exchanging contracts on the sale of our property in Danbury and according to the buyers it appears that there is a possibility that the property was constructed on contaminated land. Any high street Danbury lawyer would know that there is no such problem. It does beg the question why the buyers used an online conveyancing practice rather than a conveyancing solicitor in Danbury. We have lived in Danbury for 5 years we know that this is a non issue. Should we contact local Authority to obtain clarification that there is no issue.

It sounds as though you may have a conveyancing lawyer currently acting for you. What do they say? You must check with your lawyer before you do anything. It is very possible that once the local authority has been informed of a potential issue it cannot be insured against (a bit like being diagnosed with a serious illness and then taking out life insurance to cover that same sickness)

I moved into my apartment on 6 May and my personal details are still not on the land registry website. Any reason for this? My conveyancing solicitor in Danbury advises it would be recorded inside ten days. Are properties in Danbury particularly slow to register?

As far as conveyancing in Danbury is concerned, registration is no faster or slower than the rest of the country. Rather than based on location, timeframes can vary depending on the party submitting the application, whether it is in order and whether the Land registry must send notices to any 3rd parties. Currently approximately 80% of submission are fully dealt with in less than three weeks but occasionally there can be extensive delays. Historically registration takes place once the new owner has moved in to the premises thus 'speed' is not always top priority yet if there is a degree of urgency associated with the registration then you or your conveyancer should communicate with the Registry to express the reasoning for the application to be prioritised.

Yesterday I discovered that there is a flying freehold element on a house I put an offer in a fortnight ago in what was supposed to be a straight forward, chain free conveyancing. Danbury is where the house is located. What do you suggest?

Flying freeholds in Danbury are rare but are more likely to exist in relation to terraced houses. Even where you use a solicitor outside Danbury you must be sure that your lawyer goes through the deeds diligently. Your bank may require your conveyancing solicitor to take out an indemnity policy. Some of the more diligent conveyancing solicitors in Danbury may decide that this is not enough and that the deeds be re-written to give you the most up to date legal protection. If so, the next door neighbour also had to sign up to the revised deeds. It is possible that your lender will not accept the situation so the sooner you find out the better. You should also check with your insurance broker as to whether they will insure a flying freehold premises.
