I am not in a position to travel far from Kensal Green. Is there a reason why all Kensal Green conveyancing practitioners aren't included on all mortgage company panels?

Banks point to the fact that solicitor-led fraud is thought to be responsible for millions of pounds of fraud every year. The dismissal of law firms off of lender panels started with the rise in mortgage fraud, which prompted a thematic review by the FSA in 2011. Its outcome included recommendations for lenders to review their conveyancing panels, which triggered a major policy change in the sector. This resulted in lenders purging less reputable firms from their official list of approved property lawyers .

I am hoping to complete my purchase in Kensal Green next Monday. I have now been asked to send a copy of my building insurance schedule by my solicitor as as she informs me that she is duty bound to validate that it is in order for the lender. What does the insurance need to cover?

All property lawyers on acting for banks would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in a lender’s UK Finance Lenders’ Handbook instructions. These requirements are not unique to conveyancing in Kensal Green.

Is there a reason why leasehold purchase conveyancing in Kensal Green costs more?

Kensal Green leasehold properties involve far more paperwork than a freehold purchase, and therefore takes more time to examine and advise upon.Conveyancing will involve the lease having to be checked which is usually a lengthy document, queries raised to ensure that the covenants and conditions have been observed. If it is a flat there will be a management company in existence and the accounts of this will need to be checked and enquiries raised to ensure it is operating efficiently and that all monies due have been paid by the Seller to the company and if not ensuring that money is paid up to date or the appropriate undertakings obtained.

I have paid off my mortgage with Nottingham. I assume I don't need a Kensal Green conveyancing practitioner on the Nottingham panel to remove the mortgage at the Land Registry. Am I right?

If you have finished paying off your Nottingham mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Nottingham mortgage from the register. Nottingham, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

  1. but are not moving to another property
  2. where Nottingham has sent the Land Registry the discharge electronically, and
  3. Nottingham has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Nottingham mortgage has been paid off.

It is unclear whether my bank requires a lease extension. I have called my Kensal Green bank branch on a couple of occasions and was told they are content with the situation and they will lend. My Kensal Green conveyancing solicitor - who is on the bank conveyancing panel- telephoned and was told they will not lend in accordance with their UK Finance Lenders’ Handbook minimum lease term requirements. Who do I believe?

Provided that the conveyancing practitioner is on the bank approved list, they must follow the CML Handbook requirements for the bank. Unless your lawyer obtains specific confirmation in writing that the mortgage company will go ahead, your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask the bank to contact your lawyer in writing confirming that they will accept the number of years left on the lease.

I had an offer accepted on a house in Kensal Green on 28/11/2025, valuation was booked 4 days later, all came back fine. Property lawyer appointed, so the only thing outstanding was my mortgage offer. Having made daily calls to Nationwide and chasing them on my offer, I have now been told that my offer will not be issued unless the lawyer is on the Nationwide conveyancing panel. Can the lender hold off the offer?

A lender would not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Nationwide to deal with your lawyer's application to be on the Nationwide conveyancing panel. There's no guarantee that your solicitor will be accepted.

Despite weeks of looking the Title Certificate and documents to my home are lost. The lawyers who conducted the conveyancing in Kensal Green 4 years ago have long since closed. What are my next steps?

These day there are duplicates made of almost everything, and your solicitor will be aware exactly where to find all the appropriate paperwork so you can buy or dispose of your house without any difficulty. Where copies are not available, your lawyer may be able to put in place insurance or indemnities protecting you against possible claims on the premises.
