We are buying a 1 bedroom apartment in Newcastle with a mortgage from Allied Irish Bank. We have a lawyer but Allied Irish Bank says she’s not on their "panel". We have to appoint one of the Allied Irish Bank panel firms or keep our solicitor and pay for one of their panel ones to represent them. This seems very unfair; is there anything we can do?
Unfortunately,no. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the Allied Irish Bank conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your solicitors to apply to be on the conveyancing panel for Allied Irish Bank
Please help. My conveyancer is assuring me that she is duty-bound to apply for a Local Authority search as the firm are on the Allied Irish Bank solicitor panel. Is this really necessary?
You have limited options available to you. As you are taking a mortgage with Allied Irish Bank your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Allied Irish Bank’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Allied Irish Bank. even if you were a cash buyer you would be ill advised not to carry out a local authority search.
Is it necessary during the course of the conveyancing process to attend the offices of the Allied Irish Bank conveyancing panel solicitor to execute the legal charge? If so, I will choose one who does conveyancing in London
so that I can attend their offices when needed.
Most conveyancing panel lawyers for Allied Irish Bank undertake all of the work via the post, internet or over the phone. This means that they can undertake your Conveyancing Transaction no matter where you live in England or Wales. However you should check if you can still book an appointment to go into appointed conveyancing lawyer if you prefer.

There is nothing to stop you using your solicitor but Allied Irish Bank will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.

Getting recommendations is a sensible start. Before you go ahead check if they offer a no sale no fee offer. Also you often get what you pay for - a firm which quotes more will often provide a better service than one which is cheap as chips. We would always advise that you speak with the lawyer handling your transaction

Allied Irish Bank do not ordinarily appoint firms on their approved list of lawyers to deal with such a matter. If they did require any legal work then you would need to ensure that such a lawyer was on the Allied Irish Bank panel

Is there anyway to cut out the solicitors to save on the costs? My father said that years ago it was possible to take the documents into the local Land Registry office and they did the rest
If you are getting a mortgage with Allied Irish Bank involved you will need to appoint a solicitor on the Allied Irish Bank conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to Allied Irish Bank.
