I have just been informed by my IFA that my property lawyer is not on the Gen H Solicitor panel. How can I be certain that this is indeed the case?
The best course of action for you to take is to contact your conveyancer. You lawyer should advise you what has happened. If they are not on the panel they may recommend you to a firm that is on the the approved Gen H solicitor panel.

You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Gen H approved panel is to comply with the CML Handbook requirements (last updated for this lender on Gen H). The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.

Your Gen H conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Gen H mortgage is registered as a charge at the Land Registry.

If you are getting a mortgage with Gen H involved you will need to appoint a solicitor on the Gen H conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process.
