Common questions asked concerning the RBS (One Account) Solicitor Panel

I am expecting a offer of a mortgage from RBS (One Account). I would like to employ the services of a Licensed Conveyancer. Does the RBS (One Account) Conveyancing panel include Licensed Conveyancers
RBS (One Account)’s approved solicitor list is, like many other lenders represented by the Council or Mortgage Lenders or Building Society Association, open to Licensed Conveyancers regulated by the CLC.
Our conveyancer has discovered a problem with the lease for the flat we are purchasing. The seller’s lawyers have suggested defective title insurance as a workaround. We are content with insurance and will cover the costs. Our solicitor says that as he is on the RBS (One Account) conveyancing panel he must be satisfied that the lender is happy with this solution. Who is the client here, us or RBS (One Account)?
The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and RBS (One Account) are the client. A precondition to being on the RBS (One Account) approved panel is to comply with the CML Handbook requirements (last updated for this lender on RBS (One Account)). The CML Handbook conditions require your lawyer to disclose issues such as defects will the lease so that RBS (One Account) can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected . Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
I am looking for competitive conveyancing fees. Can I be confident that all the practices that are listed on your directory are on the RBS (One Account) conveyancing panel?
The law firms on our directory have advised us that they are on the RBS (One Account) panel and agreed to advise us to take down their listing in the event of removal off of the RBS (One Account) panel. To date we have not been informed by either a lender or a member of the public that the data about a specific firm being on the RBS (One Account) conveyancing panel is incorrect.
The solicitors that just started acting on my purchase in Manchester has suddenly shut down. I only went with them because I needed a firm on the RBS (One Account) conveyancing panel and my family lawyer was not. I gave my credit card details for them to take £175 for searches. What do I do now?
If you have an estate agent involved then let them know immediately so that they advise the vendors that there may be a slight delay due to the problems encountered. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the RBS (One Account) conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new lawyers should be in a position to assist
The mortgage over my property is with RBS (One Account). Conveyancing was finalised a year ago. Should I wish to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform RBS (One Account)?
RBS (One Account) must be informed of your intention before renting your property as this is likely to be a breach of RBS (One Account)’s mortgage conditions. In many cases banks or building societies will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact RBS (One Account) directly. You need not do this via a RBS (One Account) conveyancing panel firm.
Completion of my remortgage has taken place with a loan from RBS (One Account). Conveyancing was satisfactory but I would like to complain about RBS (One Account). Who do I contact should I wish to lodge a complaint?
Almost all banks and building societies have complaints procedures. Your first point of contact should be one of the RBS (One Account) branches or the Customer Care Department at RBS (One Account) head office. Ordinarily complaints to RBS (One Account) are resolved very quickly. However if you are not satisfied that the matter is resolved you can write to the Financial Ombudsman Service who will take matters further.
Planning on purchasing a flat with a mortgage with RBS (One Account). I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Lender if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the RBS (One Account) conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the RBS (One Account) conveyancing panel
