Having sold my house in Kennington last November but the buyer keeps Skype messaging me complaining that their lawyer needs to hear from myconveyancer. What should have happened following completion?
Following your sale your solicitor should forward the transfer deeds and all additional paperwork to the buyer’s conveyancer. Depending on the transaction, your solicitor should also evidence that the home loan has been repaid to the purchasers conveyancers. There is unlikely to be post completion procedures peculiar conveyancing in Kennington.
I am considering applying for a HSBC mortgage for purchase of a newly converted (under development) in Kennington with 60% LTV. Is it compulsory to choose a solicitor on the conveyancing panel for HSBC ?
There is nothing to stop you using your solicitor, but HSBC will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.
3 months have elapsed following my purchase conveyancing in Kennington completed. I have checked the Land Registry site which shows that I paid £200,000 when infact I paid £160,000. Why the discrepancy?
The price paid figure is taken from the application to register the purchase. It is the figure included in the Transfer (the legal deed which transfers the residence from one person to the other) and referred to as the 'consideration' or purchase price. You can report an error in the price paid figure using the LR online form. In most cases errors result from typos so at first glance the figure. Do report it so they can double check and advise.
I am purchasing a new build house in Kennington with a loan from Birmingham Midshires. The builders refused to budge the price so I negotiated 6k of extras instead. The estate agent told me not reveal to my lawyer about this extras as it could jeopardize my loan with the lender. Is this normal?.
All lenders require a Disclosure of Incentives Form from the developer of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.
Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.
Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.
